THE EMERGENCY OF THE INFORMAL
REORGANIZATION
It was the restructuring of the federal Bankruptcy Act of 1978
that gave rise to the crisis manager who knows how to forestall
bankruptcy and liquidation. The 1978 act recognised that we will
in a credit-intensive society and that people and companies will
get into trouble by borrowing too much money. Creditors no
longer want to break the trading bench of debtors – the word
bankruptcy comes from the Italian banca rotta, “to break the
bench” – but to recover some of their money through the
reorganization and rehabilitation of troubled companies.
